This website ('Site') is owned and operated by Esther Beaton Wild Pictures, ABN 66 899 646 294 ('EBWP', 'we', 'our', 'us').
The terms and conditions below apply to your use of the Site and all services and functions found on the Site. By accessing and/or using the Site, you agree to be legally bound by these terms and conditions. We reserve our rights to amend the terms and conditions at any time, please check this page for updates.
If you do not agree with these terms and conditions, you should stop accessing and/or using the Site.
You may not download, borrow, copy or use any of my pictures in any way - not without contacting me and getting written license first. You may not use my photos on your website, blog, newsletter or any other use. Beware. I use Tineye and Google Images to search for any illegal use on the web and I do find them. That's when you'll get a most unpleasant surprise. It might be a hefty bill, or I might comment on your blog about your theft. One blogger is still trying to live down the embarrassment years later.
The law is very strong about copyright. It is a criminal offence (not a civil offence) and very easy to enforce. I have received numerous compensation payments for copyright infringements, some of them quite sizeable, because of the clarity and severity of the law. Don't be one of them. Stay clean. Write to me first.
It's unfortunate that I have to watermark my images with the copyright notice. I hope you understand that I have to do so in order to protect them. In some cases I've left a few un- watermarked just so they can be displayed nicely. But these images are still governed by the same copyright law and may not be copied or downloaded.
Please note that copyright laws are internationally protected and enforced. The Berne Convention has been signed by 167 countries.
Please note that all artwork prices indicated and payments made on this site are in Australian Dollar currency (AUD) and prices are inclusive of GST (Goods and Services Tax).
We accept payment via PayPal only. Once logged in, you can make your purchase via a bank transfer or your credit card. For further information regarding PayPal's payment terms and conditions please review their User Agreement
RETURNS AND EXCHANGES
If your print arrives damaged, we will replace it, naturally. Please supply photo proof of the damage and contact us immediately upon its arrival. Please note: prints should be removed very carefully from the cardboard tube. Instructions for this will be attached to the outside of the tube.
Otherwise we do not return or exchange. Please choose and measure carefully.
SHIPPING AND PACKAGING
Shipping is free within Australia. At present, we are shipping only unframed prints. Should you wish framing, please contact us.
We ship within Australia. All shipments are sent via Australia Post and are insured. You will also receive tracking details to monitor the progress of your package.
Prints are rolled into large, sturdy, cardboard tubes. They are rolled loosely so they will flatten easily in a short time. Instructions for handling and hanging are included.
Our lab will prepare your print on demand and normally ships within 2 business days. At that time you will receive your tracking number from Australia Post with an estimated time of delivery, usually up 3-6 business days. However, please allow extra time for any Covid complications.
CERTIFICATION OF AUTHENTICITY
Limited Edition prints will arrive with a Certificate of Authenticity, signed by the artist, Esther Beaton.
Our prints are produced on A2 sized paper which is 420 x 594 mm (16-1/2 x 23-3/8 in). There is a generous border of 5cm all around the image to reveal the fine art paper texture and to allow for a variety of framing styles. The image then, is centred on the paper and is approx 310 x 480 mm.
ABOUT THE PRINTS AND THE QUALITY
These artworks are prepared to the highest archival standards and quality. They are printed for us by a Canson Certified Master Printer lab in Australia.
Our choice for the paper is Canson's Arches Aquarelle. It has been manufactured consistently for over 500 years and favoured by the best watercolorists from Picasso to Warhol. This heavy 310 gsm paper is still made in France to this day of 100% cotton rag in the traditional, mould-made process, giving it superb purity and permanence.
Some of our prints are available on canvas which is a genuine Giclée Professional Edition 400 gsm canvas with excellent water resistance and stretching qualities for gallery-wrap mounting.
The ink technology used in our prints is equally stable and long-lasting. Our printers use Epson Ultrachrome pigment, which has been independently tested to give the highest archival standard today.
This combination of paper + pigment results in a beautiful texture and deeply saturated colours. Used together, they have been independently tested to last over 100 years. The canvas we use has also been tested to last over 80 years.
LIMITATION OF LIABILITY
The Australian Consumer Law guarantees certain conditions, warranties and undertakings, and gives the Customer other rights, in relation to the quality for purpose of consumer goods sold in Australia. Nothing in these Terms purports to modify or exclude the conditions, warranties, guarantees and undertakings, and other legal rights, under the Australian Consumer Law and other laws which cannot be modified or excluded. Except as expressly set out in these Terms and the Australian Consumer Law, EBWP makes no warranties or other representations in relation to the supply of goods. EBWP's liability in respect of these warranties, representations, undertakings and guarantees is limited to the fullest extent permitted by law.
Your use of, and reliance on, this Site and content is entirely at your own risk, and to the full extent permitted by law, we exclude our liability to you for all types of loss resulting from your use of, or reliance on this Site and content, however incurred, including (without limitation) for any lost profit, lost opportunity, lost revenue, lost data, losses resulting from security failure or computer viruses, or any indirect or consequential loss, resulting from your use of this Site or its content. You agree that you are on notice of our disclaimer of warranties and limitation of liability set out above and agree to these disclaimers and limitations as a condition of using the Site.
You agree to indemnify and hold EBWP harmless from any demands, loss, liability, claims or expenses (including legal fees and costs on a full indemnity basis) made against EBWP by you or any third party due to, arising from or in any way connected to your access and/or use of the Site or purchase of our goods
